2. Application of these Terms

These Terms & Conditions apply to your use of our website and to purchases, quotations, orders, repairs and services supplied by UNO, unless specific written terms apply.

By using our website, requesting a quotation, placing an order or accepting goods or services from UNO, you agree to these Terms & Conditions together with any specific sales terms provided to you.

If you are a consumer under the Consumer Protection Act 68 of 2008 (CPA) or an electronic transaction consumer under the Electronic Communications and Transactions Act 25 of 2002 (ECTA), nothing in these Terms limits or excludes your non-excludable statutory rights.

3. Website Use and Electronic Transactions

Information on our website is provided for general information and product selection assistance.

Before placing an order, you must review the product details, pricing, delivery charges, payment information and delivery details and correct any errors before final submission.

No order is binding on UNO until we have accepted it in writing, issued an invoice, confirmed stock availability or otherwise confirmed acceptance.

4. Product Information and Availability

Images, descriptions, colours, specifications and availability may vary and are subject to change without notice.

We take reasonable steps to ensure information is accurate; however, customers remain responsible for confirming suitability, compatibility, dimensions, technical requirements and intended use before placing an order.

5. Pricing, VAT and Quotations

All prices exclude VAT unless expressly stated otherwise.

Delivery, courier, installation, assessments, repairs, storage and other charges may be charged separately.

Unless expressly stated to be fixed, prices and quotations are estimates and may change due to supplier increases, exchange-rate fluctuations, stock availability or changes to the order.

Quotations remain valid for fourteen (14) days from the date of issue unless otherwise stated and must be accepted in writing.

6. Payment

Payment is due upon delivery or collection unless written credit facilities have been approved by UNO.

Where approved credit terms apply, payment is due within thirty (30) days from the statement or invoice date, as specified by UNO.

If payment becomes overdue, all outstanding amounts may immediately become due and payable.

To the extent permitted by law, UNO may:

• Charge interest at 3% above the Standard Bank overdraft rate.
• Suspend further deliveries.
• Cancel outstanding orders.
• Recover goods not fully paid for.
• Recover legal costs on the attorney-and-client scale together with collection commission.

Customers may not withhold payment or set off amounts allegedly owing by UNO except where prohibited by law.

7. Ownership and Risk

Ownership of all goods remains with UNO until full payment has been received.

Risk passes in accordance with our Shipping & Delivery Policy together with any specific written delivery terms, subject to applicable law.

8. Delivery

Delivery is governed by our Shipping & Delivery Policy.

Delivery timeframes are estimates unless expressly agreed in writing.

If a customer refuses or fails to accept delivery without lawful reason, UNO may recover reasonable storage, delivery, handling and other associated costs and may cancel the order or claim damages, subject to applicable law.

9. Returns, Refunds and Warranties

Returns, refunds and warranties are governed by our Returns & Refund Policy and Warranty Policy.

Any handling or restocking fee applies only to discretionary non-defective returns and never where the customer is exercising a statutory right.

10. Services and Repairs

Services and repairs are governed by our Service & Repairs Policy.

Non-warranty repairs require quotation approval before work commences unless otherwise agreed.

11. Liability

To the fullest extent permitted by law, UNO shall not be liable for indirect, special or consequential loss, loss of profit, production loss, business interruption or damages arising from incorrect use, misuse, unauthorised alterations, incorrect installation, unsuitable product selection or failure to follow instructions.

Where legally permitted, UNO’s liability relating to goods or services is limited to the invoiced value of the goods or services giving rise to the claim.

Nothing contained in these Terms excludes liability that cannot lawfully be excluded, including liability arising under consumer protection legislation, fraud, wilful misconduct or gross negligence where such exclusion is prohibited.

13. Privacy and Cookies

We process personal information in accordance with our Privacy Policy, POPIA Compliance Statement and Cookies Policy.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

Subject to applicable law, the parties consent to the jurisdiction of the Magistrates’ Court in terms of Section 28 of the Magistrates’ Courts Act 32 of 1944, even where the claim exceeds that court’s ordinary monetary jurisdiction, without limiting UNO’s right to approach any court with competent jurisdiction.

15. Changes to these Terms

UNO may update these Terms & Conditions from time to time.

The version published on this website or supplied at the time an order is placed will apply to the relevant transaction unless otherwise agreed in writing.
